XII. Non derogation

Article 88a is the derogation provision.

In contrast, the African Charter does not contain a derogation clause.

Article 88a(1) regulates the preconditions for when derogation is acceptable.

A further notification is required upon the termination of the derogation. In cases of derogation the Committee considers whether the State party has satisfied the conditions of article 4 of the Covenant and, in particular, insists that the derogation be terminated as soon as possible.

These instruments provide for derogation of that right during genuine emergency situations.

The trend towards regionalization of solutions to refugee situations, however, could be interpreted as a new form of containment of refugee movements, and hence a derogation from the principle of international responsibility.

Similarly, the Covenant listed rights from which there could be no derogation in the event of emergency, while the Constitution took the opposite approach, stipulating those from which derogation was permitted.

Derogation should be explicit so that the intention to derogate was clearly demonstrated.
